番禺区见义勇为人员奖励和保障实施细则
Enforcement Regulations on Awarding and Guaranteeing Justice-Holding Volunteers in Panyu District

第一条 为弘扬社会正气，鼓励见义勇为并保障见义勇为人员的合法权益，根据《广州市见义勇为人员奖励和保障实施办法》，结合本区实际，制定本细则。

Article 1 Pursuant to Implementation Measures on Awarding and Guaranteeing Justice-Holding Volunteers in Guangzhou and based upon practical conditions in the District, the Regulations is hereby formulated to foster healthy social trends, inspire the spirit of doing boldly what is righteous, and guarantee lawful rights and interests of justice-holding volunteers.

第二条 本细则适用于本区行政区域内实施见义勇为人员的奖励保障工作。

Article 2 The Regulations apply to the work of rewarding and guaranteeing justice-holding volunteers in the administrative area of Panyu District. 

第三条 本细则所称见义勇为，是指根据《广州市见义勇为人员奖励和保障实施办法》规定，不负有法定职责、法定义务的人员，为保护国家利益、社会公共利益或者他人的人身财产安全，制止正在发生的违法犯罪行为或者实施救人、抢险、救灾等行为。

保安员、辅警、治安联防员、交通协管员等负有约定义务的人员，与违法犯罪分子英勇搏斗或者实施救人、抢险、救灾行为，应当确认为见义勇为行为。

公民救助有赡养和抚养义务的直系亲属的行为、有监护职责的公民救助被监护人的行为，应当视为履行法定义务，不认定为见义勇为行为。

Article 3 According to Implementation Measures on Awarding and Guaranteeing Justice-Holding Volunteers in Guangzhou, the term “brave acts for righteousness” in the Regulations refers to the actions done by people without statutory duties and obligations, who stop ongoing criminal offences or rescue people, handle emergencies, provide disaster relief and others to protect national interests, public interests and others’ personal and property security. 

Those with contractual obligations like security guard, auxiliary police officers, public security defenders and traffic coordinators struggle with criminal offenders courageously or save people in danger, deal with emergencies, and provide disaster relief. The aforesaid actions shall be defined as brave acts for righteousness.   

Citizens deliver on their support and maintenance obligations to take care of immediate family members, and citizens with guardianship duties look after the wards. The aforesaid actions shall be defined as fulfilling statutory obligations, not as brave acts for righteousness.

第四条 区政府成立番禺区见义勇为评定委员会，由区委宣传部、区公安分局、区财政局、区教育局、区民政局、区司法局、区人力资源和社会保障局、区住房城乡建设局、区卫生健康局、区见义勇为基金会组成，负责组织实施本细则。

评定委员会办公室设在区公安分局，负责对见义勇为事迹的审核、确认和奖励，定期整理和分析评估工作中存在的问题，组织、协调、指导各成员单位开展工作，根据实际工作需要提请召开评委会议。

Article 4 The evaluation committee of brave acts for righteousness was established by the District People’s Government. It is composed of the District Party Committee Propaganda Department, the District Public Security Sub-Bureau, the District Finance Bureau, the District Education Bureau, the District Civil Affairs Bureau, the District Judice Bureau, the District Bureau of Human Resources and Social Security, the District Bureau of Housing and Urban-Rural Development, the District Health Bureau, and the District Foundation for Justice and Courage. It shall take charge of organizing and implementing the Regulations.

The office of the Evaluation Committee is located in the District Public Security Sub-Bureau. The Committee shall be responsible for reviewing, recognizing and rewarding brave acts for righteousness, regularly sorting out and analyzing issues in the evaluations, and organizing, coordinating and guiding the work of various member units. Furthermore, as required by the actual work, it shall convene a meeting of reviewing brave acts for righteousness.

第五条 发生在本区行政区域内的见义勇为行为，行为人及其近亲属可以向本区见义勇为评定委员会申请确认见义勇为行为。有关单位和个人也可以举荐见义勇为人员。

申请、举荐确认见义勇为的，应当自行为发生之日起6个月内提出。

没有申请人、举荐人的，区见义勇为评定委员会可以依照职权予以确认。

Article 5 For brave acts for righteousness occurring in the area within the jurisdiction of Panyu District, justice-holding volunteers and their close family members shall apply to the District Evaluation Committee for recognition of their brave acts for righteousness. Relevant units and individuals shall also recommend justice-holding volunteers.  

The application or recommendation for recognition of brave acts for righteousness shall be made within six months from the date of the occurrence of brave acts for righteousness.

For brave acts for righteousness without applicants or recommenders, the evaluation committee shall recognize them in accordance with its functions and power.

第六条 申请确认见义勇为行为的，可以向行为发生地所属镇（街）提出申请，应当提交以下材料：

（一）行为人的身份等有关基本情况。

（二）行为人受伤、残疾或者死亡的，提交法医鉴定、司法鉴定机构证明、评残证明或者死亡证明。

（三）行为发生的时间、地点、经过材料或者公安机关的询（讯）问材料。

（四）有关单位、人员的见证材料。

Article 6 Those to apply for recognition of brave acts for righteousness shall file an application to the sub-district where brave acts for righteous happened, with the following proof materials submitted.  

1. Basic information including the identity of the justice-holding volunteer;

2. Injury reports, disability certificates or death certificates about justice-holding volunteers appraised and issued by forensic doctors and judicial expertise institutions if the volunteers get injured or disabled, or sacrifice;

3. Materials about the time, place and process of brave acts for righteousness occurred, or interrogation or enquiry records of concerned public security organs;

4. Witness materials provided by relevant units and personnel.

第七条 镇（街）受理见义勇为书面确认申请或者举荐后，应当会同属地公安机关在3个工作日内组织调查、取证并将相关情况及材料报区见义勇为评定委员会办公室，区见义勇为评定委员会办公室应当于镇（街）受理之日起30日内组织评定并作出书面决定；因申请举荐材料不足或情况复杂需要延期的，经区见义勇为评定委员会负责人批准，可以延长10个工作日，并告知申请人或者举荐人。对未确认为见义勇为的，应当书面告知申请人或者举荐人并说明理由。

遇有重大、疑难问题的，区见义勇为评定委员会办公室组织召开全体成员会议，由全体成员进行投票表决，并按照少数服从多数的原则作出决定。当出现票数相同的，由区见义勇为评定委员会办公室再次召开全体成员会议进行表决，作出决定。

Article 7 After receiving a written application or recommendation for recognition of brave acts for righteousness, the sub-district, together with local public security organ, shall conduct an investigation and gather evidence within three workdays, and organize an evaluation and make a written decision within 30 days from the day of acceptance. In case of postponement for lack of application or recommendation materials or complicated conditions, the evaluation shall be prolonged by ten workdays upon approved by the person in charge of the evaluation committee, and the applicants or the recommenders shall be informed. For those who are not recognized as justice-holding volunteers, the applicants or the recommenders shall be informed in writing, with the reasons added.  

When major and knotty problems happen, the District evaluation committee of brave acts for righteousness shall convene a plenary session, where all members shall vote and make a decision based upon the principle of the minority subject to the majority. In the event of the same number of votes, the evaluation committee shall convene another plenary session to vote and make a new decision.  

第八条 对拟确认为见义勇为的人员，除《广东省见义勇为人员奖励和保障条例》第二十八条第一款规定的情形外，应当将其事迹在番禺区政府网站予以公示并征求公众意见。公示时间不得少于7个工作日，不计入确认工作时间。

Article 8 For justice-holding volunteers to be recognized, unless the circumstances stipulated by Paragraph 1 of Article 28 from the Regulations on Awarding and Guaranteeing Justice-Holding Volunteers in Guangdong Province, their deeds shall be posted on the Panyu District Government website for public opinions. The publicity time shall not be less than 7 workdays, which is excluded from the confirmed working time.

第九条 经审核确认的见义勇为人员，由区见义勇为基金会颁发一次性抚恤奖金：

（一）牺牲的，颁发30万元抚恤奖金。

（二）按照最高人民法院等发布的《人体损伤程度鉴定标准》，构成重伤的，根据受伤程度颁发5万元至10万元抚恤奖金；构成轻伤的，根据受伤程度颁发1万元至5万元抚恤奖金。情节特别突出的，酌情增加抚恤奖金。

（三）对未达到轻伤标准，但是见义勇为行为事迹突出，社 会影响较大的，颁发3000元至1万元抚恤奖金。情节特别突出的，酌情增加抚恤奖金。

Article 9 For justice-holding volunteers recognized by the evaluation, the District Foundation for Justice and Courage shall award a one-time pension bonus. 

1. The pension bonus of RMB 300,000 shall be awarded to those who sacrificed.

2. According to the Standards for Assessing the Extent of Bodily Injuries issued by the Supreme People’s Court, those with serious injuries shall be awarded a pension bonus from RMB 50,000 to 100,000 based upon the degree of injury. Those with light injuries shall be awarded a pension bonus from RMB 10,000 to 50,000 based on the degree of injury. As to those with prominent contributions, the pension bonus shall be raised at the discretion of the evaluation committee.

3. For those who fall short of the standards for light injuries, but fully show the spirit of doing boldly what is righteous with greater social impact, the pension bonus from 3,000 to 10,000 yuan shall be granted. With respect to those with special contributions, the pension bonus shall be increased as appropriate.

第十条 区见义勇为基金会的基金来源包括募集收入、捐赠收入以及其他合法收入。鼓励社会力量向见义勇为基金会捐赠。区见义勇为基金会应当制定经费使用管理办法，并视经费使用情况及时调整，专款专用。专项经费的使用和管理依法接受财政、审计部门的监督。

Article 10 The funds of the District Foundation for Justice and Courage come from fundraising, donation and other lawful incomes. It is important to encourage people from all walks of life to donate money to the District Foundation for Justice and Courage.

The District Foundation for Justice and Courage shall formulate management measures on the use of funds, and timely adjust based on the use of funds to ensure fund is earmarked for a special purpose. The use and management of special funds shall be subject to the supervision from finance and auditing departments in accordance with the law.

第十一条 区见义勇为评定委员会对见义勇为人员进行确认后，对符合《广州市见义勇为人员奖励和保障实施办法》第十三条规定的，向市见义勇为评定委员会申请市级奖励。

Article 11 After justice-holding volunteers are recognized, the District evaluation committee of brave acts for righteousness shall apply to the municipal evaluation committee of brave acts for righteousness for municipal awards to those who meet the requirements stipulated in Article 13 of Implementation Measures on Awarding and Guaranteeing Justice-Holding Volunteers in Guangzhou.

第十二条 因见义勇为而遭受人身损害并有侵权人的，侵权人或者侵权人的监护人应当依法承担侵权责任。导致见义勇为人员牺牲的，其丧葬费由侵权人或者侵权人的监护人依法承担。

侵权人或者侵权人的监护人确实无力承担、暂未抓获侵权人或不存在侵权人的，相关费用由区见义勇为专项经费垫付。

因见义勇为而遭受人身损害并有受益人的，有关费用可以由受益人或者受益人的监护人适当承担。

Article 12 Where justice-holding volunteers suffer from personal injuries due to their brave acts for righteousness, with the infringers present, the infringers or their guardians shall bear tort liability according to laws. Where justice-holding volunteers sacrifice in the process of brave acts for righteousness, their funeral expenses shall be borne by the infringers or their guardians according to laws.

Where the infringers or their guardians are really unable to bear, the infringers have not been arrested or there is no infringer, relevant expenses shall be advanced by the District special fund of brave acts for righteousness.

Where justice-holding volunteers suffer from personal injuries due to their brave acts for righteousness, with their beneficiaries being existent, relevant expenses shall be born appropriately by the beneficiaries or their guardians.

第十三条 因实施见义勇为行为而造成他人财产损失，依法应当承担赔偿责任的，由区见义勇为评定委员会在见义勇为专项经费中给予适当的经济补助。

Article 13 Where justice-holding volunteers cause property damage to others in the process of brave acts for righteousness, justice-holding volunteers shall be liable for the compensation according to laws, with appropriate economic subsidies earmarked by the District evaluation committee of brave acts for righteousness from the special fund of brave acts for righteousness.

第十四条 虚构事实或者隐瞒真相骗取见义勇为荣誉或者奖励的，由区见义勇为评定委员会撤销其荣誉称号，追回所获奖金、抚恤金和其他补助费，取消相关待遇；构成违反治安管理规定行为的，由公安机关依法予以处罚；构成犯罪的，依法追究刑事责任。

Article 14 For those who fabricate evidence or conceal the truth to defraud honors or prizes of brave acts for righteousness, the District evaluation committee of brave acts for righteousness shall withdraw their honorary titles, recover their bonuses, pensions and other subsides obtained, and cancel their relevant treatment. Those who violate public security management regulations shall be penalized by concerned public security organs according to laws. Those who constitute crimes shall be prosecuted according to laws.

第十五条 本细则自印发之日起施行，有效期 5 年。

Article 15  The Regulations shall come into force from the date of issuance, with the validity period of five years.

第十一条 区见义勇为评定委员会对见义勇为人员进行确认后，对符合《广州市见义勇为人员奖励和保障实施办法》第十三条规定的，向市见义勇为评定委员会申请市级奖励。

Article 11 After justice-holding volunteers are recognized, the District evaluation committee of brave acts for righteousness shall apply to the municipal evaluation committee of brave acts for righteousness for municipal awards to those who meet the requirements stipulated in Article 13 of Implementation Measures on Awarding and Guaranteeing Justice-Holding Volunteers in Guangzhou.

第十三条 因实施见义勇为行为而造成他人财产损失，依法应当承担赔偿责任的，由区见义勇为评定委员会在见义勇为专项经费中给予适当的经济补助。

Article 13 Where justice-holding volunteers cause property damage to others in the process of brave acts for righteousness, justice-holding volunteers shall be liable for the compensation according to laws, with appropriate economic subsidies earmarked by the District evaluation committee of brave acts for righteousness from the special fund of brave acts for righteousness.

第十四条 虚构事实或者隐瞒真相骗取见义勇为荣誉或者奖励的，由区见义勇为评定委员会撤销其荣誉称号，追回所获奖金、抚恤金和其他补助费，取消相关待遇；构成违反治安管理规定行为的，由公安机关依法予以处罚；构成犯罪的，依法追究刑事责任。

Article 14 For those who fabricate evidence or conceal the truth to defraud honors or prizes of brave acts for righteousness, the District evaluation committee of brave acts for righteousness shall withdraw their honorary titles, recover their bonuses, pensions and other subsides obtained, and cancel their relevant treatment. Those who violate public security management regulations shall be penalized by concerned public security organs according to laws. Those who constitute crimes shall be prosecuted according to laws.

第十五条 本细则自印发之日起施行，有效期 5 年。

Article 15  The Regulations shall come into force from the date of issuance, with the validity period of five years.
